Injunction In Legal Schnauzer Case Runs Contrary to Alabama Constitution's Support For Free Speech

Reporting on my incarceration has focused on a preliminary injunction that constitutes an unlawful prior restraint under the First Amendment to the U.S. Constitution. Analysts from all sides of the political spectrum have come to that conclusion.

Problems with the injunction, however, do not end there; it also runs afoul of the Alabama Constitution.

Alabama often gets tagged as a backward state, but the state constitution takes a progressive stand on free-speech matters.

Powerful support for free speech is found in Article 1, Section 4, which states in part:

"No law shall ever be passed to curtail or restrain the liberty of speech or of the press; and any person may speak, write, and publish his sentiments on all subjects, being responsible for the abuse of that liberty."

We have found at least two cases where that sentiment was used to overturn prior restrictions on speech in Alabama. That means that the civil contempt finding and resulting incarceration in my case was contrary not only to fundamental Bill of Rights law at the national level, but it also appears to conflict with the Alabama Constitution's powerful language to ensure free speech.

This is urgent. An Internet censorship plan is being finalized in secret meetings right now. We need all hands on deck at this crucial moment.

Here’s the situation: President Obama himself is in secretive meetings with key political figures and lobbyists in Asia to lock the Trans-Pacific Partnership’s Internet censorship plan into place.

well well well

we have the class that wants to have total control

and we have the constitutions, us and the states, that want to honor the reality of individual

but, the so called totalitarians are those that are controlled by the so called money changers

the money changers are lots of names of families that control all the stuff that gets controlled in the life experience in earth

and then along come the dogs that can't do but, what dogs do, get snoopy and then the digging begins

might call this time a revolution

gonna tear the plantation down, the dogs always are like that, packs of running free

Perhaps Riley and the Judge thought there was a special section for them which said all of what the constitution says, and then "except when reporting on Bob Riley and their rable". Perhaps the judge and Bob Riley need to learn how to read, then send the boys to law school. In the meantime they should all hang their heads in shame.

Bush and Blair are going to be tried for war crimes and other international breaches of the law crimes, what about you Legal Schnauzer, what was the international law crime that was also trespassed?

Times are now that the people of earth aren't being killed indiscriminately anymore, Russia basically has been the American salvation, that is the ordinary people of the USA.

The not so ordinary, the Riley cult and then the entire Republican billionaire and trillionaire and whatever this crime operation wanted it got, until now.

Look for the people who are suing Blair and Bush to put them away for the rest of their lives in jail, now that is a trial worth supporting.

May want to contact those lawyers involved, Legal Schnauzer, they need great journalists.

The journalists murdered in Iraq were and are highly revered, too.

“Crimes against Peace”: Historic Class Action Law Suit against George W. Bush By Inder Comar, April 21, 2014

Anonymous said...

She described the current international system as “victors’ justice” that supports western colonization and does not take into account the US ultimatum to Japan during World War II that led to the nuclear bombings. “This system is haunting us today,” she told the audience.

The reason the shift has been made in the international justice system, stated Bhagwat, was to support a financial system that, after the cold war, distorted the UN charter and began creating a new legal system that would work in favor of the

>> “new liberal imperialism.”

2014 Niloufer Bhagwat, professor of comparative constitutional law, told the conference how international law has been manipulated by the United States and its allies so as to avoid international prosecution for crimes they have committed.

Regarding Iraq, Bhagwat had this to say:

The entire regime of sanctions in Iraq was in gross violation of the right to life under Article six of the International Covenant on Civil and Political Rights, 1966; Article two of the European Covenant for the Protection of Human Rights and Fundamental Freedom 1950 and Article four of the African Charter on Human Rights.

She explained that special tribunals were selectively established by the UN Security Council in pursuit of the strategic and economic interests of “some of the permanent members, in violation of the basic norms of national and international criminal law; consequently special interests, via their governments, have waged successive wars nullifying all human progress through death and destruction.”

Bhagwat said a privatized form of intervention and warfare by hired mercenaries and fascistic special forces has also been used, and to restore civilization, it is necessary to try those responsible through a transparent process involving the people and countries who are victims insuring legal liability and deterrent sentences, either internationally, or within national legal jurisdictions of those accused of war crimes or the countries where those crimes were committed.

“As for Iraqi Prime Minister Maliki’s government,” she concluded. “Even Muqtada al-Sadr said the situation has been reduced to the dark ages, and there is no other solution but for everyone in Iraq to unite and remove the government of President Maliki.”

Bush Republican isn't exactly the kind of ideology the world wants to have in the world.

Riley's Alabama didn't want to have the people other than as the Iraq people have been made into: dark ages realities.

Schnauzer has been inside the places where the Bush Republican and of course the 'liberals' too, that only want to be the imperial colonists of all.

Game is over for the criminals that have gone completely insane in the United States.

We can get to the arresting and doing the trial and other civilized actions against all that has also been rolled back here, the U.S. Constitution and the states' Constitutions, need to be taken out of the fire started by the 'elite' USA evildoers.

"WASHINGTON - The Justice Department on Wednesday unveiled the most ambitious federal clemency program in 40 years, inviting thousands of jailed drug offenders and other convicts to seek early releases as part of a new program intended to correct sentencing injustices and relieve prison overcrowding."

Above paragraphs says it all, former governor Don Seigelman should begin packing his "ditty bag" as he waits for his, too, so to be released papers who was indicted, [persecuted] prosecuted, and imprisoned under suspect, suspicious, and very questionable laws, that have never required being relaxed, because they were unlawful and illegally made to judicially exist.

The people of Alabama, regardless of party affiliations should rise together in support of Seigelman's release; obviously what has happened Seigelman is not limited to Seigelman; the question is; how many others, have been, are in jail that's not known about through these type retaliatory enforcement/judicial practices?

Deputy Attorney General James Cole, in charge, said:
"Correcting these sentences is simply a matter of fairness that is fundamental to our principles at the department, and its commitment that all Department of Justice employees stand behind," Cole said. The fundamental American concept, equal justice under law, requires that our laws be enforced fairly - and not just going forward.

"Now is the time for all good men to come to the aid of their {Alabama] country.

Defenders of an open, innovative and fair internet are up in arms Thursday after learning the Federal Communications Commission is about to issue new rule proposals that will kill the online principle known as “net neutrality.”

The death of net neutrality—which has governed the equal treatment of content since the internet was created—will create, say critics, a tiered internet that allows major internet service providers like Comcast and Verizon to cut special and lucrative deals with content providers who can afford to pay for special “fast lanes.” The result will be an internet that will incentivize slower traffic by ISPs and the creation of privatized, corporate-controlled “toll-roads” that will come to dominate a once fair and free environment.

“If it goes forward, this capitulation will represent Washington at its worst.” —Todd O’Boyle, Common Cause

As reported by various outlets, the new rules have been circulated by FCC chairman Tom Wheeler to the other members of the commission and will be officially announced on Thursday.

“With this proposal, the FCC is aiding and abetting the largest ISPs in their efforts to destroy the open Internet,” said Craig Aaron, president of the media advocacy group Free Press. “Giving ISPs the green light to implement pay-for-priority schemes will be a disaster for startups, nonprofits and everyday Internet users who cannot afford these unnecessary tolls. These users will all be pushed onto the Internet dirt road, while deep pocketed Internet companies enjoy the benefits of the newly created fast lanes.”

Representative Barry Moore's arrest now raises the question[s] once more addressing selective prosecution, prosecutorial discrimination, and political bias in this election year season.

It's more than reasonable for any average minded person to believe after what occurred, subsequently happening to Roger Shuler, followed by his 5 months incarceration has not drawn interstate political strategizing for 2014 elections in some way.

Far more serious and interesting involving Roger Shuler being victimize and denied of his constitutional and civil rights is unknown what's flying under the radar by while maybe unbelievable, the U.S.D.O.J. since has involved elected and employed government officials revealing practices and patterns designed to SHUT SHULER UP.

As much as many of us our here sympathize and empathize with how you've been so unfairly and illegally treated, the clock is still running and so is the pervasive corruption problem in Alabama! Now is not the time tocave to the crooks and let them win!

You have a power and a voice most do not and to let it all fall by the waste side and lose your audience due to being victimized just as those you have written about over the years have been is only playing into the hands of those trying to shut you up! If they can keep your focus on your own troubles then they alienate you from those who's attention you have for so long had while at the same time taking you down! PLEASE dont let them win!

This is a crucial year for Alabama and its citizens being that it is an important election year. As the previous Anon pointed out, arrests are being made and there are more to come! One would be foolish to not think that you have aided in this long over due process and that what you have accomplished through your efforts over the years is of no benefit to those fighting the same beast! Your crafty style is desperately in high demand and low in supply. The NJ mafia run press in AL is in a state if black out and many who have long been comatosed by the false fascade of the criminal racket running this state are beginning to wake up and seek justice and answers! You need to continue providing that info! Although for your sake and those of your readers, play it more carefully! There is an opportunity for you to bury the hatchet with some of those you have sought to expose (ie; the AL AG) in the past because it appears they are finally getting off their asses and kicking some around. Looks like Mike Hubbard is next in line to feel a well deserved wrath of the people he swore to serve and protect! The same grand jury who indicted Wren and Moore, are breathing down his neck and his pompous responces to those indictments have folks braced with wonder, amazment and popcorn in hand ready for the show! Siegleman has been granted a chance at appeal! The Neo-Cons in the republican party have begun taking off their sheep skins and turning on the Conservatives all across the state! Many conservatives have been black balled from the party in recent months and denied ballot access on June 3rd. Its a total cluster f--- of a political climate and you need to jump on board! This Republican Party takeover is peaking and dividing our state and their chances to stay in power! This plan they have unfolding is no doubt the reason you were jailed to shut you up just as many who posed a threat have been over the last several years!

You were starting to peak yourself with all the hard work you put in and have many many behind your efforts. Dont lose that base you built and let them win! Especially not now! Shake it off, pull up your boot straps and get back in the game! You are a star player now and need shine yourself back up a bit by showing them they didnt break you! If you have to, rent your house out, use only cash and go in the road for a while til the dust settles. Its time to snap out of it and get back on track but like I said before, play it careful and smart! There is enough going on now that you need not dig too deep even to to find it! The mob cover has been blown on the Riley's, Hubbard and many many more! Please join the land of the living again! We've missed you and need you back! Thats not to say we dont want to see updates to your ordeal although just not everyday is all! Its breeding bordom and complacency and its not productive without a change up. I dont mean to come across as though Im not interested in whsts taking place in your personal case, just think its time for a strategy adjustment and time is of the essense! Dont let all you worked at and accomplished over the years all be for nothing!

Glad you are back and prayers to you and Mrs S!

Alsonoticed that the day you received word of this sites existance those posts to that site had been freshly made. No dates yet, only times. So how did Riley know about it before you did begs your attention? He's nothing but slithering worthless reptile that needs to be beheaded with a garden hoe! He needs to quit drawing all this unnecessary attention to himself and others he's been putting himself out there for. Know when to fold um Robo! You look like an a$$. Dumb move too because more and more people everyday now are learning what a numb nuts you really are! Cauing a lot of bad press for Papa Riley too in the process. Did your Mama and Yale not teach you better skills than that?

Down in south Alabama former coroner exposes State of Alabama Department of Forensic Sciences for having about 38,000 lingering cases; for two s.e. Alabama counties, Houston and Henry the former coroner remarks that some inmates are being held up to, maybe over two years without going to trial, ever being indicted.

Up here in north Alabama, how does such numbers, situations compare to, say counties such as Shelby county? Since a matter of public interest why not post the number of, and longest length of time, cases waiting to go to trial, for indictment[s]; just for comparisons involving Alabama Department of Forensic Sciences.

Point here is clear. How much tax payer's money involving the arrest and incarceration of Roger Shuler, was his case expensed for officially for a politician's personal vendetta. Shuler spent 5 months without bond in jail.

38,000, is it not possible that some, even if not but one maybe not guilty, as Shuler, but is sitting during these up to two years.

If you have never spoken to an attorney out-of-state about Alabama law, coming to the state trying a case, practicing........
You should try it, the reputation outside the State of Alabama's judiciary is looked upon as a mockery of the judicial system.

Yesterday, federal officials took into custody the reputed partner of gambling boss Sheldon Adelson, the chief financial backer for the American-Israel Public Affairs Committee (AIPAC) and primary financier for America’s GOP or Republican Party.

Sources at the Department of Justice say Adelson is accused of laundering $364 million dollars, much of which went into the pockets of politicians in Washington “friendly” to Israel.

If Adelson is indicted, and sources in the Justice Department say this process is well underway, politicians around the US, all Republicans, will be required to return millions in what would then be not only illegal campaign contributions but clearly proof of ties between the GOP and organized crime.

Many of the politicians Adelson has supported on state government level have worked to suppress wages and workers’ rights, blocked regulations protecting consumers from mortgage and investment fraud and supported questionable gambling initiatives.

Adelson’s extremist politics have been a dark stain on the soul of America.

Critical is Adelson’s virtual control of America’s pro-Israel Republican Party. The GOP had hopes of using Adelson cash to gain control of the United States Senate. Analysts predict that were this to happen, America would not only move toward domestic collapse but there is a real possibility that regions of the US would seek to withdraw from the union, seeking an “autonomous zone.”

While it was initially thought that Grimm would be indicted on charges connected to his 2010 campaign fundraising, which have been under investigation by the Justice Department, the New York Times reported it would be on federal fraud charges.

The paper said the charges will include mail fraud and wire fraud and focus on his conduct in connection with a health food restaurant he owned on the Upper East Side of Manhattan after he left the FBI.

Grimm's office did not immediately return calls seeking comment. A spokesman for the U.S. Attorney in Brooklyn said he could not confirm, deny or comment on the report.

Grimm is the GOP, Conservative and Independence candidate in the race and cannot be taken off the ballot unless he moves out of the district, runs for a judgeship or is convicted before the general election.

The Justice Department has been probing whether Grimm, working with Israeli national Ofer Biton, took illegal campaign contributions from the congregation of Upper East Side Rabbi Yoshiyahu Pinto.

Grimm is up for re-election this year and is facing Democrat Domenic M. Recchia Jr.

Grimm faced controversy earlier this year when he threatened to throw a NYT reporter from a Capitol balcony.

Anons @ 6:05 and 6:43 PM April 24, 2014

Did sources at the Justice Department and The York Times make any reference to the uninvestigated campaign contributions to Alabama's Attorney General Bill Pryor and U.S. Senator Jeff Sessions after having been documented during the "witch hunt" to persecute former governor Don Seigelman?
Several thousands of dollars what was reported, right, by Montgomery area businessman.

Was there any information on investigations into trips to Las Vegas, the Bahamas, Bowl Games, etc; or optional brown bags with various amounts of pocket monies?

Update whatever else maybe generally applicable.

For way to long many are those poor and without advocates having been targeted with silencing for the securing of self-centered individuals protections of safe harbors without fear of exposures, affecting their ladder climbing within the "social registers" on the backs of the poor and minorities. Whoa is he in believing that their legacies built upon such injustices will survive historians favorably.

Wren, Moore, and Hubbard are beyond "Poppycock", U.S. Senator Sam Irwin during 1973 Watergate" hearings.

The Alabama Republican Party has consciously allowed, encouraged itself to sink to levels of putrid individual and in concert political contaminations from which there are not any public escaping of responsibilities and subsequent accountabilities to the very people who elected and employed them all, Alabamians.

Near, will be the surfacing revelations many a good Alabamian paid dearly for trying to get made known publicly
before silenced! True fact based Alabama documents.

Karl Rove did his best with Sheldon Adelson to get Romney elected to keep the G.O.P. in the power position that got set-up by "Boss Rove". No elected position this corrupt criminally insane, was in charge of the G.O.P. especially in taking Alabama, for the Riley and other Republicans that wanted to do what they've done.

Don Siegelman was a curse to the G.O.P., what the national power meant for the Democrats with Don Siegelman as Governor of AL.

Bush did the actions that Siegleman did, many times and Don one time did what all do, and that was that.

How corrupt is the Rove South, well Don Siegelman isn't free and he is innocent, too, just like Roger Shuler.

Until the Justice Department in the Washington D.C. corruption is not corrupt, then we have the mafia running the country by the laundering of whatever 'money' can be moved.

China right now is purchasing New York, Manhattan. Russians were, but the Ukraine situation stopped the Russians from purchasing the cheap in NYC, half what flats cost in such as Hong Kong.

Thanks to the G.O.P. and the corruption of the Rove and Adelson backers of the "Project For A New American Century", there is no such "Hope" for US citizens that thought we were free Americans.

Debt slavery is all there is, so what do we do about the bad?

Republican Alabama promised the most open government since the Democrats held control for years, as a supposedly non-open gov.

Why the G.O.P. has the worst possible reputation is the trust happens to be the Rove and Adelson types that are scum and rose to the top, now that has ended but all we have is contamination everywhere and everywhere.

State Dept Launches "Free The Press" Campaign As DoJ Tries To Jail Reporter

The US State Department announced the launch of its third annual "Free the Press" campaign today, which will purportedly highlight "journalists or media outlets that are censored, attacked, threatened, or otherwise oppressed because of their reporting." A noble mission for sure. But maybe they should kick off the campaign by criticizing their own Justice Department, which on the very same day, has asked the Supreme Court to help them force Pulitzer Prize winning New York Times reporter James Risen into jail.

Next the whole body is poisoned and this is factual.

Government of America, those that have been intentionally made GMO.

Sad very sad. Obama is one of the pushers of MONSANTO, and that's what is wrong with the pigs in America, all of them are feral and not, definitely not human anymore.

Look at "Government" very carefully, the woman who pushed Monsanto is gigantic.

Then the GOP Governor, Christie, Rove another one.

Does Alabama have a legal and lawful functioning Alabama Bureau of Investigation; why, when private citizens approach with certified state documents having been intentionally made objects of fraud for purpose of others gains, but ABI refuses to even accept copies of state's own copies...........

There will come a time when all those having any interest in equal rights will have remembered the origin of these times focused on today exposing same plus more attempting to escape public from knowing them for what they have done to others, have been and

Perhaps the time has come to rewrite a "natural medicine" brand of psychology that does not hide the truth about human behavior into modern-day contexts so as to shield the larger systems of evil and oppression. Why should we subscribe to any set of rules about what constitutes normality and mental disorders when the rule book is being drafted by the very control system that looks to keep the overall prison planet agenda intact? Just recently it was reported that the American Psychiatric Association now considers the behavior of self photographing (commonly referred to taking "selfies") as a mental disorder. This new disorder, of course, will be treatable with pharmaceutical medication. With claims such as these can we continue to trust the DSM and the APA to tell us what is and isn't a mental disorder? Even more interesting is the newer definitions of mental disorder that the DSM is now implementing. New definitions are said to be highly subjective and focus on the biological definition confirmed not with biology but with subject lists of behavior observations. The depth of this growing problem of subjectively defining what mental disorder is without actual proof, should not surprise anyone aware of the new world order agenda.

Let us no longer kid ourselves or be afraid to confront the evil that surrounds us. America is diving deeper and deeper into a very dangerous and violent police state. And the soldiers carrying out the mission don't think like you do. You will have to reconcile what is at the root of these societal problems. This is but one angle of the problem we must all deal with. Ultimately, tyranny and fascism is a mental disease where the person is acting in a disconnected manner to that of his or her fellow human. We are dealing with a control system whose own psychiatry text books state that a person who inflicts suffering and pain upon themselves has a mental disorder, yet that same person can inflict the same pain and suffering on another and not be considered mentally handicapped. Doesn't that say something about our own violent nature?

Paraphrasing, how press rights, civil rights, and political rights are at our [U.S.] nation's core, and we reject restrictions.

Previously having stated that, "No man is above the law".
Where is there now located that any of the above is an optional function to be used and abused against "we the people"?

Aforementioned since 1776 been accepted and believed throughout the states;

when history reveals the dedicated Governorship of post civil war State of Alabama George Houston, who earned, and was common knowledge he ran a politically professional administration and his actions spoke for themselves; "for the people, by the people, of the people".

The President other U.S. leaders talk abroad of other countries needs to improve their human rights; maybe if they would start first, now, at cleaning at their own nation's door. President Obama remarked that he was offended in having to respond to the U.S. even having any human rights problems. WELL, HOW MANY INDIVIDUAL CASES WOULD IT REQUIRE OF "WE THE PEOPLE" VIA SCHNAUZER IN COMPOSITE FOLDERS TO GET HIS UNDIVIDED ATTENTIONS.

Governor Seigelman was persecuted and prosecuted for political motivations, Obama could have by now pardoned him, BUT WHY DID OBAMA APPOINT THE U.S. ATTORNEY IN MONTGOMERY THAT HE DID, SUBSEQUENTLY BILL PRYOR TO ANOTHER JUSTICE DEPARTMENT APPOINTMENT; although Seigelman continues to sit in prison but, OBVIOUSLY WITNESSED WAS Alabama's U.S. Senator Jeff Sessions sitting next to Obama at the National Day of Breakfast while Dr. Ben Carson spoke.

Point: Is President Barack Obama as close knitted to other solid Republican based states, if so, why? If not, then why so much aligned for Alabama political positions? Should warrant fair discussions............

Is President Barack Obama, his administration so aloof, arrogant, detached that they really are not cognizant of the severity of human rights [civil rights/constitutional rights] violations within the boundaries of his authorities and jurisdictions????????????????
