Did Alabama Lawyer Jennifer Paige Clark Die Because She Refused To Sell Out Her Own Clients?

The Alabama State Bar harassed one of its member lawyers to death, probably because she refused to sell out her own clients, a Legal Schnauzer investigation shows.

The lawyer in question was Jennifer Paige Clark, who was found dead at her Mobile home last May 26, nine days after the state bar had suspended her license on charges that our research shows were unfounded. The clients were Ms. Clark's parents, Larry and Hilda Clark of Flowery Branch, Georgia.

At least three major oddities about the Jennifer Paige Clark case strongly suggest that bar officials knew they had no legitimate grounds for investigating her, much less imposing discipline. So why did they do it? It's almost certainly because Ms. Clark was doing exactly what lawyers are supposed to do--she was providing her clients with zealous representation, and certain judges did not welcome that.

Our investigation shows Ms. Clark uncovered facts that made powerful interests uncomfortable in two states. When politically connected judges could not force her off the trail, they apparently sicced the Alabama State Bar on her. The bar responded by charging Ms. Clark with rules violations that she clearly did not commit--and by conducting a disciplinary trial that, public documents show, make a kangaroo court look dignified by comparison.

What politically connected judges are we talking about? No. 1 on the list is Georgia Superior Court Judge Jason Deal, the son of the state's Republican governor, Nathan Deal. Public records suggest that Judge Deal did not appreciate an Alabama lawyer aggressively pursuing a case against a Georgia municipality and took steps to get Ms. Clark removed from the case. Did that include voicing his displeasure to the Alabama State Bar, leading to a baseless investigation? The answer appears to be yes. (See Judge Deal's order revoking Ms. Clark's admission to practice in Georgia, at the end of this post.)

Even the Alabama State Bar seemed to acknowledge that its original charges against Jennifer Paige Clark were bogus. How do we know? In suspending Ms. Clark's license and seeking her disbarment, the bar made almost no mention of the original charges. Rather, it cited Ms. Clark's conduct during the discipline hearing as the primary grounds for suspension.

Our review of the hearing transcript shows that Ms. Clark did not engage in inappropriate conduct--unless you consider it inappropriate to express irritation at being forced to defend yourself against trumped-up charges. Ms. Clark's main response was to repeatedly, and correctly, state that she could not violate attorney-client privilege by discussing inside information about the case. The Alabama State Bar decided such "misconduct" merited sanctions that essentially would ruin Ms. Clark's career.

Nine days after those sanctions were announced, Ms. Clark was found dead. An official cause of death still has not been announced.

Jennifer Paige Clark's story provides a tragic twist to one of many ugly truths in our dysfunctional justice system. As we have shown in several posts, your own attorney often can prove to be your worst enemy in any court battle. Why does this happen? We will provide more details in a moment, but here is the short answer: The outcomes of many legal battles, in both state and federal courts, have little to do with the relevant facts and law; rather, they often are decided by compromised judges who play favors for certain parties or attorneys.

Published reports indicate Jennifer Paige Clark did not play along with that game. Consider this section from Ms. Clark's obituary, featuring comments from Mobile County District Judge Charles N. McKnight:

Jennifer Clark could be "the sweetest person," according to Mobile County District Court Charles McKnight, and was well liked. "But get her in a courtroom and you could get something completely different,""said McKnight. "She was a very hard worker. She was tenacious to a fault. She vigorously represented all her clients regardless of their station in life. I admired her willingness to represent the lowest of the low."

If Jennifer Clark provided vigorous representation for "the lowest of the low," imagine how hard she would fight for her parents? Ms. Clark represented her parents in a pair of property-related cases, using aggressive discovery tactics--and documents in the cases indicate the Clarks uncovered misconduct involving powerful forces in two Southern locales.

One is Hall County, Georgia, which perhaps is best known to sports fans for hosting the Atlanta Falcons NFL training camp at Flowery Branch. Gainesville, the county seat, is where former Congressman and current Georgia Governor Nathan Deal built his political base.

The other hot spot is in Baldwin County, along Alabama's Gulf Coast and home to a burgeoning real-estate market where beachfront condominiums can yield massive profits for certain developers.

What about the three oddities that raise serious questions about the Alabama State Bar's motives and actions in the Jennifer Paige Clark case? Here they are:

* The Alabama State Bar initiated the investigation on its own--The bar can do this under Rule 3(c) of the Alabama Rules of Disciplinary Procedure. But I know from personal experience, and based on information provided by other citizens, that the state bar routinely declines to investigate cases where evidence of attorney wrongdoing is clear and irrefutable. That suggests it is rare for the bar to launch an investigation on its own.

* There was no client complaint against Jennifer Paige Clark--Our research indicates the vast majority of bar investigations are launched by a client complaint. But there was no such complaint against Ms. Clark; by all accounts, her parents were pleased with her representation.

* The investigation was launched based on information that Jennifer Paige Clark provided to the bar--You heard that correctly: The Alabama State Bar launched an investigation because of information that Ms. Clark herself sent to them. That strongly indicates Ms. Clark did not have a "guilty mindset." Would she have copied the bar on correspondence that she thought contained a violation of bar rules? Of course not. Ms. Clark clearly did not think she was violating any rules, and our research indicates she was correct about that.

Why do so many lawyers turn against their own clients? For many, it's a matter of survival in a profession where the pursuit of power and billable hours has become far more important than the pursuit of justice.

In far too many cases, corrupt judges decide that one party or attorney is going to receive a favorable judgment--or at least will not suffer the kind of damages that might be inflicted in an honest court. That leaves the other attorney to convince his client that it's best not to push too hard--that justice really is being done, even though it might not look that way.

Experience has taught me that the stronger your case, the more likely you are to be the victim of such a con game. That tells me that Hilda and Larry Clark probably had very strong cases--both in Hall County, Georgia, and in Baldwin County, Alabama.

Many lawyers, under pressure from corrupt judges, would have convinced the Clarks to either give up on their cases or accept offers that amounted to a fraction of what the cases were worth. If that didn't work, many lawyers would have withdrawn from the cases, keeping the Clarks' money and leaving them to seek other counsel or fend for themselves.

Jennifer Paige Clark apparently did not treat her clients that way. And she certainly was not going to treat her parents that way.

By refusing to go along with the game that many lawyers are expected to play, did Jennifer pay with her career--and her life. We think the answer is yes.

    But, the journalism deep mole investigation is a creative genius gift and We People millions must have the truth of information to deductively reason how to solve the complex problems.

    Problems are how we humans evolve our "thinking stuff." Our multi-billion dollar brain cannot be reproduced in spite of all the hype that technology is "God."

    Imagination is an individual experience and unique at all times.

    We collective humans, are also problem solving individuals and therefore, co-creators of our OWN 'self' and 'collective' "reality/ies."

    This is a serious problem in the United States of America: death due to honest brokering of our chosen individual and collective reality/ies.

    Time for change. The POTUS is a serious in our imaginations dis-ease in outer reality/ies.

    Sounds like the bar didn't really have anything on Ms. Clark, so they suspended her for defending herself. She didn't grovel enough before the bar? That was her great sin?

    Of all the stories you've covered, and I read your blog most every day, this one on Jennifer Paige Clark bothers me the most. A good woman died because she dared to not let corrupt judges and bar officials tell her how to represent the best interests of her clients. And as far as I know, the possibility of murder has not been ruled out. I grieve for Jennifer, and I grieve for her family. And I pray that the people responsible are made to pay.

  7. You learn to practice real law in law school. Once you are licensed to practice, you have to do your job the way the bar wants you to do it. There is a big difference between the two, and it's why many lawyers hate their chosen profession.

    Thanks for sobering insights from an insider. I think a big issue here is that Jennifer Clark engaged in serious discovery that uncovered events and information that someone did not want disclosed. The U of Alabama is stonewalling on discovery in the Amy Bishop shooting case. I was allowed to conduct no discovery at all in my lawsuit against the U of Alabama. Jennifer Clark wouldn't put up with such crap, so she drew an attack.

  15. A woman prosecutor in Portland, Oregon, found dead in her home. She was always in the a.m., ready for the 'dog walker,' who arrived to find the woman dead.

    NO investigation nor has the murderer been 'found.'

    What was she DEFENDING? Ordinary people vs. the IRS.

    Too close to uncovering the demonic agendas which do indeed include the BAR and of course the 'handlers' of the BARs, and the dead are easily and effortlessly buried in a graveyard of don't ask, don't tell!

    Certainly, do NOT accuse OR expose the system of digital endless 'money' to do what the most dangerous criminals in earth do, lie-cheat-steal-kill with an immunity that can't be touched.

    HOW POWERFUL IS THE BAR?

    Frontline's "The Untouchables," should do an entire expose on the B.A.R.s and how unbelievably littered with corruption beyond any of the wildest of imaginations.

    A petition for Ms. Paige, at the very least, should Frontline not be interested in outing the killers. She was an intentional hit, just like Aaron Swartz.

    Both good questions, David. I know the family recently pushed for a determination on cause of death and was stonewalled. Not sure how the Alabama State Bar would have jurisdiction over events that took place in Georgia, where Ms. Clark had been admitted pro hac vice.

  19. Hope to hear back from Anon at 12:50, but in the meantime, I think he/she might be referring to the case of Nancy Bergeson, a federal public defender in Oregon. Her body was discovered in her Portland home in 2009, and cause of death was homicide. The case remains unsolved. Here is one of numerous good articles on the case:

It does have similarities to the Jennifer Clark story in the sense that Ms. Bergeson was described as a relentless attorney who zealously defended those charged with federal crimes. Like Ms. Clark, Ms. Bergeson was described as a woman who was active and fit and well liked by her colleagues. He mother is a former state senator in California:

  24. In my dealings with the Alabama State Bar, I and many others have found that the organization operates much like the Gestapo. Rather than protect the ones they are supposed to serve, the ones whose dues pay their salaries, they act as a goon squad with an agenda. Depending on whom the attorney is or how well connected he may be, they ignore serious violations of the rules. But when an attorney dares to stand up for what is right - well he/she better look out if that stance is opposed to that of the ASB or their cronies. Your comment naming Robert Lusk and Tony McClain "thugs" was spot on. And a casual survey of the attorneys in Alabama would hold that probably 95% of them agree. When attorneys are intimidated by corrupt judges, it is the ASB's job to defend them, not persecute them. But that is not how it works. It is past time for the attorneys in this state to rise up and put a stop to the dictatorial tactics of the ASB.

    Nancy Bergeson upon finding her client(s) correct regarding the IRS FRAUD, was shocked.

    She was extremely FIT and thus, how did she die of 'natural causes' via strangling?! Why has this unsolved 'murder' not been investigated?!

  26. If it were not for bloggers such as your self most of this information would not make it into the public eye. People do nothing about these things because they believe it couldn't happen to them. Well it can. Your blog has adequately demonstrated that.

    I would add the USA to the list of countries it isn't safe to travel to. First, all the guns and second if you are arrested your rights might very well be violated. Better to go to countries which have a fairer justice system.

    I do not see any improvement in the near future. I think it not unreasonable to conclude it will only get worse. The rule of law has become the rule of those with the most money and political influence. If you start to look at how these bar associations, judges, etc. act, along with some federal court decisions you can see this is not the home of the brave and the free but rather that of cowards, bullies, and enslaved .
    You have to wonder where some of the large civil rights organizations are. The U.S.A. has the highest incarceration rate in the western world. It isn't doing much better in the legal murder, executiion business either. What a shame.

    In a book published in early January, La Repubblica delle stragi impunite (The Republic of the Unpunished Massacres. The unpublished papers of the bloody events that have shaken our country), Italian Judge Ferdinando Imposimato places the blame on NATO for organizing the bloody attacks that ripped through Italy during the 1980’s.

    The CIA was created by the National Security Act of 1947. The ink was barely dry on it before an army of spooks began marching through the law's major loophole: the CIA could "perform such other functions and duties...as the National Security Council may from time to time direct."     Called Operation Gladio (gladius is Latin for sword), the ostensible excuse for it was laughable-the threat of a Soviet invasion.

    But the real purpose wasn't so funny-Operation Gladio's 15,000 troops were trained to overthrow the Italian government should it stray from the straight and narrow.

    Similar secret armies were formed in France, Belgium, the Netherlands and West Germany- often directed, quite naturally, by former SS officers.

    They didn't just wait around for the Russians to come marching in; they assembled huge arms caches (many of which remain unaccounted for), compiled blacklists of leftists and, in France, participated in plots to assassinate President DeGaulle.

    Have you ever wondered what the origin of the phrase 'New World Order' is?

    Earliest source I can find is from 1941. THis is the first time this quotation has ever been posted on the web. I just checked. Seems pretty clear to me, by New World Order' Wheatley means the central objective of Nazi political control. Which by no means died in 1944.

    Thankfully, though these C21 Nazi control freaks are convinced their diabolical plan is possible, they can and will never achieve it.

    They may rather burn the world to the ground trying, and failing.
