A central Alabama woman has been in the Chilton County Jail for more than seven weeks on an official charge of contempt of court. But a Legal Schnauzer investigation indicates she might be unlawfully incarcerated because of corruption connected to one or more divorce cases.
Bonnie Cahalane (Knox) Wyatt, 46, of Clanton, was jailed on July 26, and a source says she has not had contact with family members since that time.
Ms. Wyatt is incarcerated--at least on paper--because of actions related to a divorce case styled Bonnie Sue Wyatt v. Harold Jay Wyatt, which she initiated on October 5, 2009, and led to a Final Order of Divorce on May 11, 2011. Chilton County Circuit Judge Sibley G. Reynolds heard the case, and multiple sources have been telling Legal Schnauzer for months that Reynolds has a tendency to handle divorce cases in a highly irregular fashion.
Is Reynolds part of the hunting-club culture that has caused gross corruption in divorce courts in Jefferson and Shelby counties? That is not clear at this point. But his actions--and those of several lawyers and parties connected to Ms. Wyatt's case--are emitting a foul smell.
The Wyatt story is particularly troubling because it involves some sketchy characters, besides Judge Reynolds. One is Pelham lawyer William E. Swatek, who played a leading role in my own legal difficulties that started in Shelby County. Swatek has been disciplined by the Alabama State Bar at least three times, including a suspension of his license for acts of "fraud, dishonesty, misrepresentation, and deceit." Our post titled "Here's Why Americans Hate Lawyers" provides a good summary of the sleaze in Swatek's background.
Another curious character in this story is a man named Bobby L. Knox, who is one of Ms. Wyatt's former husbands. Knox is the president of Shelby Concrete, and court records indicate he possesses a substantial income that allows him to sometimes throw his weight around. Documents also indicate that Knox possesses a nasty disposition when it comes to interactions with women; he has been sued twice in federal court for sexual harassment of former female employees--and both cases were settled.
Then we have Harold Jay Wyatt, who was the defendant in the divorce case that led to Bonnie Wyatt's incarceration. What kind of person is Harold Jay Wyatt? Reviews seem to be mixed. A source tell us that Mr. Wyatt gives the impression of being a fine fellow who genuinely cared for his wife and sunk quite a bit of money into their marital residence. Court records, however, show that Harold Wyatt has been married and divorced three times, and that Ms. Wyatt took out a Protection from Abuse (PFA) order against him during the course of their marriage. He has worked as a cattle rancher and for International Paper in Selma, and his most recent address in court documents is for W V Wyatt Farm Service in Selma.
Is Bonnie Cahalane (Knox) Wyatt in jail for a legitimate reason or is she being held because someone has come to see her as a threat? Has an Alabama court become so corrupt that it would hold a woman in jail, even though it has no lawful grounds for doing so?
Ms. Wyatt has been in touch with me off and on since March 2012, discussing apparent irregularities in Chilton County divorce cases via e-mail, and I started seriously investigating her situation in late August. It wasn't until then that I discovered, via court records, that she was in jail. Her story is long and winding; it will take a number of posts to explain, and my research is ongoing. But I've learned enough to strongly suspect she is in jail because someone wants to go outside the law to punish her--or someone sees her as a threat.
The central issue in the Bonnie Cahalane (Knox) Wyatt story appears to be this: In the Final Order of Divorce in Wyatt v. Wyatt, Ms. Wyatt was ordered to pay her husband $165,000 on or before June 7, 2011. The order states that upon payment, Harold Jay Wyatt "shall satisfy the debt owing to Regions Bank on the marital residence, in the approximate amount of $108,000 and shall execute a deed conveying his interest in the marital home and real estate to the Wife.
"The Husband shall make all payments due on the above referenced debt, as well as the insurance on the home, up and until June 7, 2011, or until Wife makes payment as stipulated herein, whichever occurs first. The balance received by the Husband, over and above the payoff of the debt, shall settle all other equity issues related to the marital property."
How did Bonnie Wyatt come to owe Harold Wyatt $165,000? That's hard to understand, particularly when you consider that court documents indicate the marital home belonged to her before the marriage. Also, records show that the couple married on December 1, 2008, and separated on September 9, 2009. They lived together as man and wife for less than a year, but Bonnie Wyatt owes Harold Wyatt $165,000? How did that happen?
A hand-written document that came out of mediation in Wyatt v. Wyatt indicates Ms. Wyatt agreed to a deal paying Harold Wyatt $165,000. But we can find no copy of a formal agreement that she has signed. Ms. Wyatt sought to alter the divorce order on the grounds that new evidence showed Mr. Wyatt had made misrepresentations during the proceedings and that she had never received documentation of alleged improvements to the marital home or the use of loan proceeds against the marital home.
Judge Reynolds denied the motion to alter, and various attorneys apparently failed to follow through on Ms. Wyatt's efforts to appeal the order to the Alabama Court of Civil Appeals. Documents show that Ms. Wyatt failed to pay the $165,000, leading to her arrest for contempt of the divorce order.
Does Bonnie Cahalane (Knox) Wyatt actually owe $165,000? Do any documents prove she owes the debt, and is there any formal settlement agreement in the divorce? Has Ms. Wyatt been deprived of her freedom on bogus grounds?
Here is one oddity about the Wyatt case, at least in my experience: Most divorce cases I've seen end with a document called "Final Judgment of Divorce" or "Final Divorce Decree." The equivalent document in Wyatt v. Wyatt is styled "Final Order of Divorce," and it seems to be based on a settlement agreement--but I can find no formal agreement in the file, nothing official that Bonnie Wyatt has signed.
Why was the word "order" used in the decisive document for the Wyatt case? Did that set up Bonnie Wyatt for a criminal finding that she had violated a court order? Is that language commonly used in Alabama divorce cases or is that peculiar to Judge Sibley Reynolds?
We might discover a valid reason for Bonnie Wyatt's jail time. But at the very least, her case presents this question: Why is a seemingly civil matter being treated in a criminal fashion? If Ms. Wyatt does owe a certain sum due to her divorce, how is she supposed to pay it while incarcerated? And why does documentation regarding the alleged debt seem to be absent from the court file?

Just wondering. You never know who Harold Wyatt and his wife know. Also, court records are easy to generate for a file.
We were forced into bankruptcy by a completely bogus judgement for (inflated/wrong) legal fees based on intentional misrepresentation and distortion (lies) by my ex spouse's attorney and the court appointed GAL. Also we were ordered to see a conflict resolution counselor, that was not a counselor, and later found out that he was friends (Facebook) with my ex's attorney. He provided testimony favorable to the defendant (my ex)...imagine that. Oh BTW the DHR caseworker appointed by the Court happened to be a family freind of my ex. All motions to replace and strike the GAL and DHR reports and testimony were denied without comment. So although I just wanted the Order to be followed by my ex. I file a Contempt Motion Pro Se, we ended up getting screwed because we were not well versed in lying and manipulating the good ole boy system. If you believe that you can show up to court and tell the truth (or attempt to) and everything will be fine...think again. You may end up in a jail cell. It's not what you know, its who you know...Sweet Home Alabama.

No, I have not seen Ms. Wyatt in jail. I have seen the Chilton County Jail log that says she is in their inmate population. I've seen the arrest warrant and court documents that show she was arrested, and the case file leading up to that. I've spoken with family members who say she is in jail.
I've seen other court records that match what Ms. Wyatt had told me via e-mail about her divorce case.
Could someone connected to Alabama courts be pulling an act of deception? I don't think that's the case, but I've learned never to rule anything out in this environment.
It seems the court is using the hand-written document that came out of mediation in Wyatt v. Wyatt as justification in another railroad job.

I love Alabama. I have lived in this beautiful state my entire life. It's her government I hate. People like Reynolds make me nauseous. He hurts people because he knows he will get reelected and maintain his friendships. His circuit, the 19th Alabama Judicial Circuit, is the only circuit structured in this manner:

The judge occupying judgeship No. 1 shall be a resident of Elmore County, the judge occupying judgeship No. 2 shall be a resident of Autauga County, and the judge occupying judgeship No. 3 shall be a resident of Chilton County. A person qualifying as a candidate for election to a judgeship under this subdivision shall be a resident of the county for the judgeship the person seeks for a period of not less than one year prior to the date the person qualifies as a candidate for election to the office and thereafter during his or her tenure in office.
The 19th Judicial Circuit is the only circuit in Alabama structured in this manner. In the other judicial circuits in Alabama, the candidate wishing to qualify must only meet a residency requirement of residing in the particular circuit - not the county in which the incumbent judge resides. Of all of the attorneys in the 19th, not a single one is willing to run against any judge in this circuit because they have to practice in front of them.
Schnauzer, Sibley Reynolds hates women. I know a minimum of eight women from whom Sibley took their children with no legal cause. I am one of them.

ReplyDeleteYou hit on the fundamental problem at the heart of our justice system. The law is a self-regulating field, meaning lawyers are required to report wrongdoing by any fellow member of the bar, including a judge. But they can't do it because the judge will ruin their careers. As a result, we have a system that amounts to organized crime.
Case law from the AL Supreme Court effectively prevents the Alabama State Bar from engaging in discipline against sitting judges. So, the Bar has become highly skilled at disbarring justices-elect, mostly the Liberal/African-American types. To my knowledge, the Judicial Inquiry Commission only exercises its powers over state court judges. That means, Federal Judges, especially those who are not members of the Alabama State Bar, are beyond disciplinary action unless the US House votes to impeach.
ReplyDeleteAnother cute trick some unscrupulous attorneys employ is, say your ex's attorney writes the order, they can slip in items like property settlements, modified terms, etc. If your attorney or your representing yourself, isn't very bright and/or corrupt then judge signs the order. At that point youre screwed sans a rule 59 motion, in which a judge has to admit something was wrong...not likely. Always ask the judge to prepare the order or ask to have the opposing attorney provide you a copy to review prior to submittal. Even then it's no guarantee that things will be on the up and up. I had a property settlement (several thousand $) inserted into an order that was never discussed, even in court. I wonder if this is what happened to Ms Wyatt. Roger can you determine who wrote the order? Many of these attorneys simply copy and paste clients names into existing motions, etc. So fonts and sentence structures are similar for an attorney from case to case.

People must understand the truth. The truth is, in Alabama civil court/lawsuits, such as divorce or child custody, the Alabama judges can do whatever they want. It is that simple. They really truly can do whatever they want and there is no accountability, no requirement of them to explain or justify why they rule as they do. Once the Alabama judge makes a ruling, issues the court order, it is now a one man's opinion cast upon a citizen as law and if that citizen fails to follow the judges order (the law), that person is violating the law (the court order). Alabama judges have far too much power for a human being. Alabama judges represent the proof that absolute power corrupts absolutely. Many of us in family rights advocacy have been seeking help from Alabama legislators for over 15 years to stop the State Sponsored Child Abuse committed upon our kids by the Alabama judges. Unfortunately what we have found is that the Alabama legislators are either lawyers or owned $$$ by the lawyers & judges. You say you have spoken to people close to the family. To my knowledge this womans family has nothing to do with her because all of the vile things that she has done. She intentionally set Mr Wyatt up to get him to finish her house. That man never laid a hand on her in a violent way! She is a compulsive liar!

DeleteFYI~ Harold Wyatt is NOT a Bad person at all. He co-signed for Bonnie's daughter to buy a house wich she recently refinanced it and got it in her and her husband name. Harold has only spoke highly of her children and was happy to help her. Harold has been paying the house payments of 1800.00 a month for 3 years. They have been divorced since May 11, 2011 and she was ordered to start making the payments and still to this day has not. She was Harold third wife. Bonnie has married a lot more than 3 times. I believe she has remarried again since her divorce from Harold. Maybe Judge Reynolds was sick of her lies. Harold never abused Bonnie. She only said that while he was in the hospital having surgery and by the way never came not one time to the hospital. Let's not fail to mention she is wanted on a bad check of 3,500.00 in another county. How many men do you know that would pay for a house while he has to live with his Mother? Not any that I know of. He is a great man and Father...

If you think she is so great then why don't you build her a house? Mr. Knox paid her 200,000.00 a year plus child support so I can't see that he is a bad person either. And how many years did he pay her? She blew that money on what? Not Harold Wyatt. She used Harold and I'm sure there is a list of others. She continue to disrepect Judge Reynolds. We shall see how long she will charm you with her lies before you figure her out.

Ok I am sitting here reading all of these post and the only person who is stating facts is legal schnauzer. While some of the statements on here are just attacking everything about the woman. No one is perfect. Yes she may have done some of the things that people say she have done. But the question I am trying to answer is why hasn't this woman even been set a bail. There are people who have commited serious crimes that was even given a bail. What is going on with this woman is not right. From a source of mine I learned that her biological family may not deal with her but she has some true friends who have been there for her during this whole situation.

But it says she drew a complaint for writing one bad check. Heck, that could have been a case of bad math, the kind of stuff lots of us do in trying to balance a checkbook.

Bonnie finally met Karma... How is being granted 200k a year plus child support being screwed over by the court system? How can anyone feel sorry for a woman that received this much money for years and writes a 3500 bad check?

If anyhing shady was going on then why did Harold pay 1800 month on a house that he has not lived in over3 years? That does not make since. It took a long time to get the divorce because Bonnie would changed Attorneys all the time... This is a fact. She did not show up for court the last time. This is why she is in jail.

ReplyDeleteIt seems like to me in order to get some type of justice in Chilton County you have to be loaded with money. I have heard for years that it is one of the worst and corrupt counties in Alabama. If this is true someone need to come in and clean out all seats and start all over. From experience of a family member I know that the judges down there are not fair at all. People can not continue to be treated like this. It is unfair and unethical. And for you people who are discussing all of this woman financial dealings seem like to me you know a little too much so you are starting to make me wonder what is in the whole thing for you? Because you seem like you have it in for the woman just as much as the others.

We aren't on here talking about how many times she's been married we are in here wondering why in the hell she is still in jail for missing a court date... Chilton County should be ashame of there damn selves! I've seen drunk drivers get out the next day after bein put in jail for drinking and driving and it's not fair this system is CRAZY and something needs to be done about it. If this was you bein held bc of craziness you wild want someone to speak up for you especially if you were in jail all this time just for missing court..

ReplyDeleteTalking with someone and exchanging e-mails with someone are not the same thing. Again, I haven't talked with Bonnie Cahalane. Even in her e-mails, she made no mention of Harold Wyatt (or Bobby Knox, for that matter). She made general references to a divorce case that she felt wasn't handled properly by the court, her lawyer, or both. That's what prompted me to check court records.
Speaking of court records, they don't show all of the divorces you reference. They show divorces involving Edwards, Knox, and Wyatt--in that order. They also show three divorces for Mr. Knox and Mr. Wyatt, for what that's worth.
None of that is relevant in my view for any of these folks. We don't throw people in jail because they've been through a few divorces.
The issue here is this: Someone has been in jail for eight-plus weeks because of a divorce? Depriving someone of freedom is serious stuff, at least to me. It should never be done for improper reasons, and it never should be taken lightly.
Has this case been handled properly, regardless of what personal feelings some folks might have toward one party or another? That is the overriding question.

Why does it matter how many husbands this woman has in the past. That is not the purpose of this blog. She is not the first nor will she be the last to multiple marriages in her life time. So back off of the woman and her past and stick to the situation that is being discussed. PLEASE!!

It's a fact that she swore out such a document, and it's part of the legal process. That's what the post says.
Since this post was written, I spoke with Mr. Wyatt, and he denies that any abuse took place. Ultimately, the court dismissed the PFA and issued a joint restraining order during the course of divorce proceedings.
WELL THAT IS YOUR OPINION ABOUT REYNOLDS. BUT I FEEL LIKE ENOUGH IS ENOUGH. I FEEL LIKE THIS MAN HAS WENT TOTALLY OVER BOARD FOR HOLDING SOMEONE THIS LONG FOR NOT SHOWING UP TO COURT. I KNOW PEOPLE WHO HAVE MISSED COURT MULTIPLE TIMES AND DID NOT STAY IN JAIL THAT LONG WITHOUT A BAIL. THERE IS SOME PEOPLE WHO HAVE COMMITTED A REAL CRIME AND NEED THAT CELL SPOT.
