Let me guess: You are a lawyer from May...@9:35 -- <br /><br />Let me guess: You are a lawyer from Maynard Cooper Gale or some other entity that stands to benefit from Dr. Mark Hayden being in jail.<br /><br />It's funny to note your selective reading of court documents, highlighing what suits your agenda and ignoring the rest. I don't have time at the moment to go into all the examples, but there are many. For one, Graffeo cited the Franklin case as grounds for the injunction/contempt, and there is no question that Franklin does not provide such support, no matter how much you want to quibble about language. Franklin overturned a judge's incorrect order that punished an inmate, so it doesn't come close to supporting Graffeo's punishment of Hayden.<br /><br />As for the way the legal system "works," I know all too much about that. A little knowledge is a dangerous thing.<br /><br />When someone disobeys a court order, the last resort is that they get locked up for it. That's what contempt of court is. If you don't want to be locked up, comply with (or appeal) the court order. It's that simple.<br /><br />I urge everyone to read the documents that Dr. Hayden has filed (and to which Mr. Shuler has linked). Some interesting excerpts:<br /><br />"7. Did you appeal the decision, file a grievance, or seek an administrative remedy? Answer: No."<br /><br />"10. In this petition, are you challenging the validity of your conviction or sentence imposed? Answer: No."<br /><br />[from page 8 of 10, under Ground Three, item (a): "...they want me locked up indefinitely because I will not provide the documents of the Cashion family trust..."<br /><br />Note what he says here: Not "I don't have any documents to produce" or "the documents were destroyed" or "I lost the documents". He says, "I will not provide the documents". There's his solution: Provide the documents, get out of jail. It's that simple.<br /><br />Why is Dr. Hayden refusing to produce the documents? Why is an ER doctor - who one would expect is handsomely paid - representing himself instead of hiring a lawyer? Is it because every lawyer he spoke to told him he has no case? What is Dr. Hayden hiding?<br /><br /><br />And from your post:<br /><br />"You will notice that Graffeo cites the first sentence in Franklin's key finding, while ignoring the second sentence -- which appears to forbid his restrictions on Dr. Mark Hayden."<br /><br />Well, no, the second sentence doesn't "forbid" anything. One of these days some one is going to get killed because of it and the law suit could run into the millions. I can only hope the doctor gets out shortly and the judge get tossed out of his job. But I've been intimately involved in two such arrests, both were frighteningly violent and neither subject resisted. I was knocked to concrete floor three times and covered in mace. My wife, Carol, wound up with a shattered arm, and she was not resisting at all.
