I have seen it before, the attorney takes a case saying they will prepare for trial at a set price per hour and take a retainer. The attorney prepares the case and the retainer runs out before the court date. The attorney has provided legal services at the hourly rate and do not want to go forward unless they get more money to cover the hours invested in the case. I have witnessed judges siding both ways when attorneys attempt to withdraw. Neither option is good for the defendant. If the judge lets them out, it's hard to get someone to pick the case up without having to redo a lot of the steps the first attorney "prepared", at the defendant's cost. I don't know how legal aid works in Alabama, but if this were in B.C., the legal team might find they have to continue working for the client, at legal aid wages or a negotiated salary, less than they would usually make. Now if its a question of money, you'd wonder why Hubbard doesn't change his tactics and simply say, pay up or I tell all. He could even write book Might make for entertaining reading.<br /><br />This close to the trial date, something is afoot and I doubt it has to do with winning or loosing. It may be some one else is going to have need of the lawyer's services and they want out of the Hubbard trial to go "defend" some one else, who is "closer" to them? <br /><br />Lets hope the judge does not permit the legal team to withdraw. A number of news outlets have said Hubbard's team already has withdrawn. But that is not correct. They have asked for permission to withdraw, but the judge has not granted it yet.
