We can either do the hard and difficult work of enforcing the Convention ourselves, or we can expect a shaming by our closest allies akin to the shame enforced upon Germany at Nuremburg. In the world community there is no debate over whether waterboarding is torture. NONE! The harshest penalties will be reserved for those highest up the chain of command and that leads straight to the top. Specifically Bush, Cheney and Rumsfeld. Bush and Cheney have admitted their crimes and the proof against Rumsfeld is unimpeachable.
