Injunction In Legal Schnauzer Case Runs Contrary to Alabama Constitution's Support For Free Speech

Reporting on my incarceration has focused on a preliminary injunction that constitutes an unlawful prior restraint under the First Amendment to the U.S. Constitution. Analysts from all sides of the political spectrum have come to that conclusion.

Problems with the injunction, however, do not end there; it also runs afoul of the Alabama Constitution.

Alabama often gets tagged as a backward state, but the state constitution takes a progressive stand on free-speech matters.

Powerful support for free speech is found in Article 1, Section 4, which states in part:

"No law shall ever be passed to curtail or restrain the liberty of speech or of the press; and any person may speak, write, and publish his sentiments on all subjects, being responsible for the abuse of that liberty."

We have found at least two cases where that sentiment was used to overturn prior restrictions on speech in Alabama. That means that the civil contempt finding and resulting incarceration in my case was contrary not only to fundamental Bill of Rights law at the national level, but it also appears to conflict with the Alabama Constitution's powerful language to ensure free speech.

Perhaps Riley and the Judge thought there was a special section for them which said all of what the constitution says, and then "except when reporting on Bob Riley and their rable". Perhaps the judge and Bob Riley need to learn how to read, then send the boys to law school. In the meantime they should all hang their heads in shame.

Bush and Blair are going to be tried for war crimes and other international breaches of the law crimes, what about you Legal Schnauzer, what was the international law crime that was also trespassed?

Times are now that the people of earth aren't being killed indiscriminately anymore, Russia basically has been the American salvation, that is the ordinary people of the USA.

Look for the people who are suing Blair and Bush to put them away for the rest of their lives in jail, now that is a trial worth supporting.

Bhagwat said a privatized form of intervention and warfare by hired mercenaries and fascistic special forces has also been used, and to restore civilization, it is necessary to try those responsible through a transparent process involving the people and countries who are victims insuring legal liability and deterrent sentences, either internationally, or within national legal jurisdictions of those accused of war crimes or the countries where those crimes were committed.

“As for Iraqi Prime Minister Maliki’s government,” she concluded. “Even Muqtada al-Sadr said the situation has been reduced to the dark ages, and there is no other solution but for everyone in Iraq to unite and remove the government of President Maliki.”

Above paragraphs says it all, former governor Don Seigelman should begin packing his "ditty bag" as he waits for his, too, so to be released papers who was indicted, [persecuted] prosecuted, and imprisoned under suspect, suspicious, and very questionable laws, that have never required being relaxed, because they were unlawful and illegally made to judicially exist.

The people of Alabama, regardless of party affiliations should rise together in support of Seigelman's release; obviously what has happened Seigelman is not limited to Seigelman; the question is; how many others, have been, are in jail that's not known about through these type retaliatory enforcement/judicial practices?

As much as many of us our here sympathize and empathize with how you've been so unfairly and illegally treated, the clock is still running and so is the pervasive corruption problem in Alabama! Now is not the time tocave to the crooks and let them win!

ALABAMA INCARERATION ALERT FLASH

Down in south Alabama former coroner exposes State of Alabama Department of Forensic Sciences for having about 38,000 lingering cases; for two s.e. Alabama counties, Houston and Henry the former coroner remarks that some inmates are being held up to, maybe over two years without going to trial, ever being indicted.

Up here in north Alabama, how does such numbers, situations compare to, say counties such as Shelby county? Since a matter of public interest why not post the number of, and longest length of time, cases waiting to go to trial, for indictment[s]; just for comparisons involving Alabama Department of Forensic Sciences.

Point here is clear. How much tax payer's money involving the arrest and incarceration of Roger Shuler, was his case expensed for officially for a politician's personal vendetta. Shuler spent 5 months without bond in jail.

38,000, is it not possible that some, even if not but one maybe not guilty, as Shuler, but is sitting during these up to two years.

If you have never spoken to an attorney out-of-state about Alabama law, coming to the state trying a case, practicing........
You should try it, the reputation outside the State of Alabama's judiciary is looked upon as a mockery of the judicial system.

Adelson’s extremist politics have been a dark stain on the soul of America.

Critical is Adelson’s virtual control of America’s pro-Israel Republican Party. The GOP had hopes of using Adelson cash to gain control of the United States Senate. Analysts predict that were this to happen, America would not only move toward domestic collapse but there is a real possibility that regions of the US would seek to withdraw from the union, seeking an “autonomous zone.”

While it was initially thought that Grimm would be indicted on charges connected to his 2010 campaign fundraising, which have been under investigation by the Justice Department, the New York Times reported it would be on federal fraud charges.

The paper said the charges will include mail fraud and wire fraud and focus on his conduct in connection with a health food restaurant he owned on the Upper East Side of Manhattan after he left the FBI.

Grimm's office did not immediately return calls seeking comment. A spokesman for the U.S. Attorney in Brooklyn said he could not confirm, deny or comment on the report.

Grimm is the GOP, Conservative and Independence candidate in the race and cannot be taken off the ballot unless he moves out of the district, runs for a judgeship or is convicted before the general election.

The Justice Department has been probing whether Grimm, working with Israeli national Ofer Biton, took illegal campaign contributions from the congregation of Upper East Side Rabbi Yoshiyahu Pinto.

Grimm is up for re-election this year and is facing Democrat Domenic M. Recchia Jr.

Grimm faced controversy earlier this year when he threatened to throw a NYT reporter from a Capitol balcony.

Karl Rove did his best with Sheldon Adelson to get Romney elected to keep the G.O.P. in the power position that got set-up by "Boss Rove". No elected position this corrupt criminally insane, was in charge of the G.O.P. especially in taking Alabama, for the Riley and other Republicans that wanted to do what they've done.

Don Siegelman was a curse to the G.O.P., what the national power meant for the Democrats with Don Siegelman as Governor of AL.

Bush did the actions that Siegleman did, many times and Don one time did what all do, and that was that.

How corrupt is the Rove South, well Don Siegelman isn't free and he is innocent, too, just like Roger Shuler.

Until the Justice Department in the Washington D.C. corruption is not corrupt, then we have the mafia running the country by the laundering of whatever 'money' can be moved.

It was interesting to read ACLU's amicus brief for Roger. They demanded among other things that the judge unseal the file. The two lawyers that signed the brief stated at the bottom of their brief that even their speech was chilled by Claude Neilson. The US State Department announced the launch of its third annual "Free the Press" campaign today, which will purportedly highlight "journalists or media outlets that are censored, attacked, threatened, or otherwise oppressed because of their reporting." A noble mission for sure. But maybe they should kick off the campaign by criticizing their own Justice Department, which on the very same day, has asked the Supreme Court to help them force Pulitzer Prize winning New York Times reporter James Risen into jail.

Perhaps the time has come to rewrite a "natural medicine" brand of psychology that does not hide the truth about human behavior into modern-day contexts so as to shield the larger systems of evil and oppression. Why should we subscribe to any set of rules about what constitutes normality and mental disorders when the rule book is being drafted by the very control system that looks to keep the overall prison planet agenda intact? Just recently it was reported that the American Psychiatric Association now considers the behavior of self photographing (commonly referred to taking "selfies") as a mental disorder. This new disorder, of course, will be treatable with pharmaceutical medication. With claims such as these can we continue to trust the DSM and the APA to tell us what is and isn't a mental disorder? Even more interesting is the newer definitions of mental disorder that the DSM is now implementing. New definitions are said to be highly subjective and focus on the biological definition confirmed not with biology but with subject lists of behavior observations. The depth of this growing problem of subjectively defining what mental disorder is without actual proof, should not surprise anyone aware of the new world order agenda.

Let us no longer kid ourselves or be afraid to confront the evil that surrounds us. America is diving deeper and deeper into a very dangerous and violent police state. And the soldiers carrying out the mission don't think like you do. You will have to reconcile what is at the root of these societal problems. This is but one angle of the problem we must all deal with. Ultimately, tyranny and fascism is a mental disease where the person is acting in a disconnected manner to that of his or her fellow human. We are dealing with a control system whose own psychiatry text books state that a person who inflicts suffering and pain upon themselves has a mental disorder, yet that same person can inflict the same pain and suffering on another and not be considered mentally handicapped. Doesn't that say something about our own violent nature?

Governor Seigelman was persecuted and prosecuted for political motivations, Obama could have by now pardoned him, BUT WHY DID OBAMA APPOINT THE U.S. ATTORNEY IN MONTGOMERY THAT HE DID, SUBSEQUENTLY BILL PRYOR TO ANOTHER JUSTICE DEPARTMENT APPOINTMENT; although Seigelman continues to sit in prison but, OBVIOUSLY WITNESSED WAS Alabama's U.S. Senator Jeff Sessions sitting next to Obama at the National Day of Breakfast while Dr. Ben Carson spoke.

Point: Is President Barack Obama as close knitted to other solid Republican based states, if so, why? If not, then why so much aligned for Alabama political positions? Should warrant fair discussions............
